In a matter of grave significance, the Bombay High Court has imposed heavy costs (aggregating 30 lakhs) on both the petitioners and their advocates for restoration of two petitions that were dismissed for non-removal of office objections under Rule 986 of the High Court (original side)Rules, 1980.
The order also specifies that contingent to the payment of this amount, the delay of 1959 days shall be condoned, and the petitions shall be restored to file.
Justice Kamal Khata who presided over the bench has directed that :
1.Both the petitioners and their advocates in Writ Petition(L)No. 3075 shall pay ₹15,000,00 (₹7.5 Lakhs each) towards Poor Box Charity Fund, K.E.M Hospital, Mumbai.
2. Both the Petitioners and their Advocates in Writ Petition (L)No. 3169 of 2019 shall pay ₹15,000,00 (₹7.5 lakhs each) towards Bar Council of Maharashtra and Goa.
Additionally, the court has directed that the costs be paid within two weeks from the date of uploading of the order on the Bombay High Court website.
Both Interim Applications were accordingly disposed of.
